1. Cancellation and Returns
1.1 Consumer Contracts Regulations 2013 offers the following cancellation rights:
Please note that you are entitled to cancel this contract if you so wish, provided that you exercise your right no longer than 14 days after the day on which you receive the goods or services. All damages must be reported within 48 hours of receipt.
Please note that your right to return products does not apply to goods made to your specification, that have been clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly.
If you wish to exercise your right of cancellation, you are obliged to retain possession of the goods and take reasonable care of them.
To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear statement including details of your name, geographical address, details of the order you wish to cancel and, where available, your phone number and email address.

If you decide to cancel, you should return the goods to us at your own cost within 14 days of such cancellation and we will reimburse to you (by the method used to pay for the original transaction) the amount in relation to goods to which cancellation rights apply. We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will make the reimbursement no later than 14 days after the day we receive back from you any goods supplied.
1.2 If you wish to cancel your order please email email@example.com or call us on 07963 659 854 to notify us of your reason to cancel.
a) If your cancellation is prior to dispatch and if your payment has gone through it will be refunded in full using the original method of payment.
b) If your Goods have been dispatched please refer to clause 1.1. where we operate a cancellation policy of this contract at any time before the expiry of 14 calendar days after the day you received the Goods (the ‘Cancellation Period’). The costs of returning the Goods will be covered by you and will be by registered post to: Babyshine.efc

RG12 9HT. We cannot be held responsible for any Goods returned that are lost in transit therefore affecting your refund.
c) When we receive the Goods you will be refunded by the original method of payment.
d) We reserve the right to deduct the RRP (recommended retail price) of any returned Goods where tags have been removed, become damaged due to recipient mishandling or become unsealed after delivery. Or for any Goods which are bespoke or have been personalised in any way or which may deteriorate (such as chocolates).
e) The provisions of Clause (1.2d) do not affect your statutory rights as a consumer. If the goods arrived damaged or faulty or the goods are not what you ordered please provide a full description (and photograph where possible) of the issue by email at, firstname.lastname@example.org or by telephone on, 07963 659 854. We will then ask you to return the defective item/s in the original packaging (where possible) to the address above with all receipts. Under these terms we will pay registered postage for the return of Goods and arrange a refund or replacement whichever you require. In some cases if you wish a replacement product rather than a refund we can simply send you the replacement product without requiring the damaged or faulty product to be returned.
2. Order Terms
2.1 All orders are subject to our acceptance and availability. If any Goods ordered are not available, we will email you to give you the option either to wait until the item is available, offer an alternative to the same value or you have the option to cancel your order.
2.2 Our acceptance of your order happens when we receive confirmation of payment for your order. A contract between you and us will only subsist after we have debited your payment card and have confirmed that we have dispatched the Goods.
We will send you a confirmation email of payment. We will send you a further email upon dispatch.
2.3 We will not accept an order where we cannot obtain authorisation for your payment or if there has been a pricing or product description error.
2.4 We will endeavour, but cannot guarantee, to dispatch your order within 24 hours from receipt of payment Monday to Friday and notify you of dispatch. Dispatch may take up to 48 hours or more if ordered Saturday or Sunday or Public Holidays. Please allow an extra 3-5 working days before dispatch for any orders that include personalised items.
2.5 We can only accept orders for delivery within the United Kingdom and Europe.
3. Delivery Terms
3.1 We offer our customers free Royal Mail Signed For 2nd Class Postage on all orders £40 or over for delivery within the United Kingdom. Royal Mail 2nd Class Post aims to deliver your item in 2-3 working days, not including weekends. Please note – delivery may take longer due to circumstances out-with the control of Babyshine.efc.
3.2 We reserve the right to stop our offer of ‘Free Royal Mail Signed For 2nd Class Postage on all, or certain Goods,’ at our discretion and without prior notice.
3.3 Other options of Goods delivery are by Royal Mail and are chargeable to you as follows:
a) For orders less than £40: Royal Mail Signed For 2nd Class. Royal Mail aims to deliver your item in 2-3 working days. Requires a signature on delivery. (£3.95)
b) Royal Mail Signed For 1st Class. Royal Mail aims to deliver your item the next working day. Requires a signature on delivery. (£6.50)
c) Royal Mail Guaranteed (Next Day) Special Delivery. Royal Mail Delivers by 1pm the following working day if urgent delivery is required. (£11.00.) Please ensure you place your order by 12.30pm, Monday to Thursday for next working day delivery. Please Note – Orders received on Friday and by 12.30pm on Saturdays will be delivered on the following Monday. Orders received after 12:30pm on Saturday or Sunday will be delivered on the following Tuesday. This service always requires a signature on delivery. Refunds (by Royal Mail) for delivery costs will not be given for next day deliveries, if the delivery is delayed for example due to traffic conditions, or there is no-one available to receive the delivery. Check with Royal Mail for full details.
3.4 For purchases of a single bodysuit, teether, wash mitt, hat, bib or card, the postage is £0.99 for Standard 2nd Class Delivery.
3.5 International delivery options are available. Pricing options can be found at checkout. We are unable to provide time estimates for deliveries outside the United Kingdom.
3.6 Babyshine.efc is not responsible for any delays in delivery or non-delivery of Goods from time of dispatch.
4. Payment Terms
4.1 Prices for our goods are the prices quoted on our Website. The prices shown exclude delivery postage which will be added to the total amount due by you except where you choose the Free Postage option at checkout. We reserve the right to amend our prices and postage charges at any time.
4.2 By placing an order, you consent to payment being charged to your debit/credit card account or electronic payment account as provided at checkout. All transactions are shown in pounds sterling (£).
4.3 Payment will be debited and cleared from your account before the dispatch of the Goods to you.
4.4 Once your payment has been received, you will receive an electronic receipt to your nominated email address.
5. Product Terms
5.1 Babyshine.efc boxes are not toys and are not intended for use by children.
5.2 Although we have made every effort to show the colours of our products as accurately as possible we cannot guarantee that your device’s display of the colours reflects the colour of the products accurately. Your product may vary slightly from those images.
5.3 We reserve the right to provide replacement products at any time when certain products are; no longer being stocked by us or; no longer available to us or; are delayed in arriving from our supplier or; have been modified by the manufacturer. We will endeavour to advise you of these changes prior to your order being dispatched, but cannot guarantee to always do so.
5.4 We put a lot of care into packaging our gifts and products so they will look beautiful upon arrival. If, when received by you or the recipient, any of the products are damaged, we would ask you to contact us within 48 hours of receiving. See section 2. Cancellation and Returns for more details.
5.5 Complaints – If you have a comment, concern or complaint about any Goods you have purchased from us, please contact us via email at email@example.com or by telephone on 07963 659 854 and we will deal with the issue quickly and fairly. We endeavour to respond within 24 hours Monday to Friday apart from public holidays.
5.6 Please ensure your spelling is checked carefully on orders of personalised items. We will personalise as per the text received in the order. Please note that your right to return products does not apply to goods that have been clearly personalised. If the item has been incorrectly personalised by Babyshine.efc and differs from the text received in the order, we will offer a full refund or replacement of the product.
6. Personal Information
6.1 We will use the personal information you provide to us to:
a) supply the products to you and/or your recipient;
b) process your payment for the products; and
c) if you agreed to this during the order process, to send you information about similar products or offers that we provide from time to time, but you may stop receiving this at any time by contacting us or opting out.
7.1 In order to receive certain discounts or offers and to make future ordering easier we may ask you to register by choosing, and being responsible for, a username and password. We will not disclose your details to third parties.
7.2 All the details you provide to us for the purpose of registering on this Website and purchasing the Goods are true, accurate, current and complete in all respects.
7.3 We reserve the right to cancel your registration immediately at our reasonable discretion if you breach any of these terms and conditions.
8.1 While we endeavour to ensure that this Website is available 24 hours a day, we will not be liable if for any reason this Website is unavailable at any time or for any period.
8.2 Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.
8.3 This website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s) and you access them at your own risk.
9. General Terms and Conditions
9.1 Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this Website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
9.2 Your use of this website and any dispute arising out of such use of this website is subject to the laws of England, Northern Ireland, Scotland and Wales.
9.3 You agree to indemnify us fully, defend and hold us, and our officers, directors, employees and agents, harmless from and against all claims, liability, damages, losses, costs (including reasonable legal fees) arising out of any breach of the terms and conditions by you, or your use of this Website, or the use by any other person using your registration details.
9.4 We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from our website.
